By accessing the CarisWest website, using our booking applications, or securing our services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.

2. Scope of Services

CarisWest provides residential and commercial property inspections, environmental testing, and related consulting services.

• Separate Agreements: The specific scope, limitations, and exclusions of any physical inspection or testing will be governed by a separate, legally binding Service Agreement provided to you prior to the inspection. In the event of a conflict between these Terms of Service and your specific Service Agreement, the Service Agreement shall take precedence.
• Non-Destructive Nature: Unless explicitly stated otherwise in writing, all property inspections are visual and non-destructive. We do not guarantee or warranty that hidden defects will be discovered.

3. Booking, Payments, and Cancellations

• Scheduling: Appointments requested through our online booking application are not finalized until confirmed by our dispatch team.
• Payments: Payment is required prior to the release of any final inspection reports or data. We use secure third-party processors (e.g., Stripe) for credit card transactions.
• Cancellations: If you need to cancel or reschedule an appointment, we require a minimum of 24 hours' notice. Cancellations made with less than 24 hours' notice may be subject to a cancellation fee.

4. User Responsibilities & Property Access

To effectively perform our services, you agree to:

• Provide accurate and complete information regarding the property, billing, and contact details.
• Ensure our technicians have safe, legal, and timely access to the property at the scheduled time.
• Secure any necessary permissions from current owners, tenants, or listing agents prior to our arrival.

5. Communications & SMS Consent

By providing your contact information, you consent to receive transactional communications from CarisWest, including email, phone calls, and SMS text messages related to your bookings, reports, and billing. You may opt out of SMS messages at any time by replying "STOP". Please review our Privacy Policy for more details on how we handle your data.

6. Intellectual Property & Report Ownership

All website content, software, and branding are the intellectual property of CarisWest.

• Inspection Reports: Upon full payment, you are granted a non-exclusive license to use the final inspection report for your personal or business real estate transaction. The report is prepared strictly for the named client and may not be relied upon by third parties without our written consent.

7. Limitation of Liability

To the maximum extent permitted by law, CarisWest, its employees, and its agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from:

• Your use of our website or booking systems.
• Unauthorized access to or alteration of your transmissions or data.
• Any actions taken based on the information provided on our website prior to a formal Service Agreement.

Our total liability for any claim arising out of or relating to these terms shall not exceed the amount you paid to us for the specific service in dispute.

8. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or our services shall be resolved through binding arbitration in Jefferson County, Washington, or another mutually agreed upon location.

9. Modifications

We reserve the right to update or modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services following any changes constitutes acceptance of the updated Terms.
